Terms and Conditions (T&C)

1. General

These Terms and Conditions (hereinafter “T&C”) apply to all legal transactions between Alma Behluli Xhelili (sole proprietorship, hereinafter “Nanush”) and customers (hereinafter “Customer”) in connection with orders placed via the online store.

By placing an order, the Customer confirms that they have read, understood, and accepted the T&C.

Nanush reserves the right to amend these T&C at any time.
The version published on the website at the time of the order shall be decisive.

2. Offer

The products displayed in the online store do not constitute a legally binding offer, but a non-binding invitation to place an order.

The offered product range may be changed, restricted, or expanded at any time.
There is no entitlement to the permanent availability of specific products.

3. Order and Conclusion of Contract

Orders can be placed exclusively via the online store.

By submitting an order, the Customer makes a binding offer to purchase the selected products under the conditions shown during the ordering process.

The contract is concluded as soon as Nanush confirms the order or begins preparation and/or delivery.
Nanush reserves the right to refuse orders without stating reasons.

4. Customer’s Duty of Care

The Customer undertakes to provide truthful, complete, and up-to-date information when placing an order, in particular regarding their personal details, delivery address, and availability.

Nanush is not liable for damages, delays, or undeliverable shipments caused by incorrect, incomplete, or misleading information provided by the Customer.

5. Delivery

Delivery is available exclusively within the delivery areas in Switzerland defined by Nanush.

The delivery conditions applicable at the time (e.g., delivery times, pre-order deadlines, minimum order values, delivery fees) are set out in the online store and during the ordering process and are binding at the time of the order.

Stated delivery times are non-binding estimates.
No guarantee is given that specific delivery times will be met.

Late delivery generally does not entitle the Customer to cancel the order or receive a refund.

If delivery cannot be made, or can only be made with difficulty, for reasons outside Nanush’s responsibility (e.g., incorrect address, Customer not available), there is no entitlement to a renewed free delivery or compensation.

6. Prices and Payment

The prices displayed in the online store at the time of the order apply.
All prices are in Swiss francs (CHF).

Payment is made using the payment methods offered in the online store.
No delivery will be made until full payment has been received.

7. Changes and Cancellations

Due to the fresh preparation and perishability of the products, orders generally cannot be changed or cancelled once preparation has begun.

Any exceptions or deadlines are stated in the online store.

8. Right of Withdrawal

There is no right of withdrawal.
Freshly prepared food is excluded from exchange and return.

9. Allergens and Intolerances

The offered products may contain ingredients that can trigger allergies or intolerances.

The Customer is responsible for informing themselves about the ingredients before ordering and, if necessary, making inquiries.

10. Resale

Resale of the delivered products is not permitted without Nanush’s express consent.

11. Warranty and Liability

The Customer must inspect the goods immediately upon receipt and report any defects without delay.

Nanush is not liable for damage resulting from improper storage or handling of the goods after handover.

Nanush is not liable in cases of force majeure or events outside its control.

12. Data Protection

Personal data is processed in accordance with the Privacy Policy published on the website.

13. Applicable Law and Jurisdiction

Swiss law shall apply exclusively.

Place of jurisdiction is the registered office of the sole proprietorship.
